BAT for Ukraine - Improving the framework conditions for the implementation of the European Directive 2010/75/EC on industrial emissions and promoting the use of best available techniques (BAT) in industry

By signing an Association Agreement with the European Union, Ukraine has agreed to comply with EU climate targets and the Industrial Emissions Directive (IED). A key aspect of achieving these national climate targets will be ensuring that best-available techniques (BAT) are deployed in the country’s industrial infrastructure. A regulatory framework for transposing the EU Directive into law has been lacking to date. Accordingly, the project is promoting capacity building in companies and state-run facilities, while providing support to the responsible ministries as they develop the legal framework and monitor compliance. In relation to BAT, the project is aiming to facilitate capacity building for domain experts and management in ministries, for environmental regulators and for plant operators. This, in turn, will enable Ukraine to reduce the greenhouse gas emissions from its industrial sector by the deployment of innovative industrial processes and procedures.

State of implementation/results

 

  • Despite the Russian Federation's attack on Ukraine, the project to implement the concept of Best Available Techniques (BAT) in Ukraine is continuing with a high level of commitment and in good cooperation with the Ukrainian Ministry of Environmental Protection and Natural Resources (MEPR).
  • After several years of preparatory work, Law No. 6004-d on the implementation of the EU Industrial Emissions Directive (2010/75/EU, IED for short) was passed at first reading by the Ukrainian parliament, the Verkhovna Rada, on 29 May 2023. The IED is the legal basis for the application of BAT in the EU. The Parliament's Environment Committee recommended final adoption with formal amendments at the beginning of August 2023. The final vote on the law is still pending.
  • The development of the sub-legislative framework that will enable full implementation of Best Available Techniques in Ukraine is well advanced. As the draft law on the implementation of the IED provides for short deadlines for the adoption of secondary legislation, the corresponding drafts should be ready for approval as soon as possible with the adoption of the implementation law.
  • On behalf of the project, international and national companies are developing software that can be used to apply for and issue licences for industrial plants online. Most of the development work has now been completed. Only the electronic implementation of the application form and the format of the actual permit are still outstanding. Following the programming, comprehensive tests are planned.
  • The ten translations of BAT reference documents into Ukrainian planned within the project have been completed. Following the completion of several roundtables for the general presentation and categorisation of the documents, technical working group meetings are currently being held to discuss the translation of leaflets and conclusions on Best Available Techniques.
  • The project has developed a financing mechanism to support Ukrainian companies in implementing the concept of Best Available Techniques. A project implementation unit consisting of operational and technical consultants and project staff has been established. The tender documents for implementation projects to be funded were published in January 2023. By the end of March 2023, a total of 25 short applications for funding for modernisation projects had been received, six of which were selected for funding. Modernisation measures are planned to reduce emissions to air and water, to treat in-house waste, to switch fuels and to increase energy efficiency in food production, metal production and energy conversion companies. Two companies have since cancelled their funding, while the implementation prospects for another are unclear. A grant agreement was signed with one company at the end of 2023, and preparations are well advanced for two others.
  • The official kick-off event for the project took place on 9 July 2019 in Kyiv with the participation of a delegation from the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety (BMU). Among those present were Parliamentary State Secretary Rita Schwarzelühr-Sutter and Ukrainian Deputy Environment Minister Mykola Kuzio.
