BAT for Ukraine - Improving the framework conditions for the implementation of the European Directive 2010/75/EC on industrial emissions and promoting the use of best available techniques (BAT) in industry
By signing an Association Agreement with the European Union, Ukraine has agreed to comply with EU climate targets and the Industrial Emissions Directive (IED). A key aspect of achieving these national climate targets will be ensuring that best-available techniques (BAT) are deployed in the country’s industrial infrastructure. A regulatory framework for transposing the EU Directive into law has been lacking to date. Accordingly, the project is promoting capacity building in companies and state-run facilities, while providing support to the responsible ministries as they develop the legal framework and monitor compliance. In relation to BAT, the project is aiming to facilitate capacity building for domain experts and management in ministries, for environmental regulators and for plant operators. This, in turn, will enable Ukraine to reduce the greenhouse gas emissions from its industrial sector by the deployment of innovative industrial processes and procedures.

State of implementation/results
- After several years of preparation and with support of the project, Law No. 3855-IX on the implementation of the EU Industrial Emissions Directive (2010/75/EU, or IED) was adopted. The law officially entered into force on August 8, 2025. This milestone brings Ukraine into compliance with EU standards and introduces a modern system of integrated environmental permits based on Best Available Techniques (BAT) as well as a comprehensive approach to the management of industrial emissions.
- The development of secondary legislation enabling the full implementation of Best Available Techniques in Ukraine is well advanced. The law implementing the IED sets short deadlines for the adoption of secondary legislation. Therefore, the Ministry of Economy, Environment, and Agriculture, with support from GIZ, is working intensively to finalize these regulations for approval. The Cabinet of Ministers of Ukraine has already adopted 15 regulations, while five additional draft laws are currently undergoing the interministerial approval process again.
- International and national companies have developed software on behalf of the BVT project that allows for the online application and issuance of integrated environmental permits for industrial facilities. Extensive testing of the system was conducted. The new registry for integrated environmental permits was published in August 2025 on the government platform “Ecosystem” eco.gov.ua and has been fully operational since September 2025.
- The project has developed a financing mechanism to support Ukrainian companies in implementing Best Available Techniques. Planned measures include modernization efforts to reduce emissions to air and water and to treat on-site waste in food production and metal manufacturing companies, as well as to increase energy efficiency in paper and cardboard production. To date, a total of two funded projects have been completed (Zhytomyr Cardboard Factory and Radyvylivmoloko), while two additional projects (Kremenchuk Steel Works and LVN Limited) are currently ongoing.
- Starting in late August 2025, a series of training sessions on the new licensing system was conducted with the support of the project, attended by key stakeholders, including representatives from businesses, civil society organizations, and regional government administrations. A total of approximately 450 people participated in the training sessions. In addition, on November 13, 2025, the BVT project organized a follow-up dialogue to discuss practical issues related to the new permitting procedure. About 180 people attended this event.
- In December 2025, representatives from MinEconomy and other government agencies participated in a study tour to the Czech Republic, designed and implemented by the project, to exchange experiences regarding the practical implementation of the European Union’s Industrial Emissions Directive (Directive 2010/75/EU).
- With the project’s support, a concept for a government program to support companies that implement and apply Best Available Techniques through 2030 was developed and adopted.
