BAT for Ukraine - Improving the framework conditions for the implementation of the European Directive 2010/75/EC on industrial emissions and promoting the use of best available techniques (BAT) in industry

By signing an Association Agreement with the European Union, Ukraine has agreed to comply with EU climate targets and the Industrial Emissions Directive (IED). A key aspect of achieving these national climate targets will be ensuring that best-available techniques (BAT) are deployed in the country’s industrial infrastructure. A regulatory framework for transposing the EU Directive into law has been lacking to date. Accordingly, the project is promoting capacity building in companies and state-run facilities, while providing support to the responsible ministries as they develop the legal framework and monitor compliance. In relation to BAT, the project is aiming to facilitate capacity building for domain experts and management in ministries, for environmental regulators and for plant operators. This, in turn, will enable Ukraine to reduce the greenhouse gas emissions from its industrial sector by the deployment of innovative industrial processes and procedures.

State of implementation/results

  • Despite the Russian Federation's attack on Ukraine, the project to implement Best Available Techniques (BAT) in Ukraine is continuing with a high level of commitment and in close cooperation with the Ukrainian Ministry of Economy, Environment, and Agriculture (MinEconomy).
  • After several years of preparation, Law No. 3855-IX on the implementation of the EU Industrial Emissions Directive (2010/75/EU, IED for short) was passed. The law officially entered into force on August 8, 2025. This milestone brings Ukraine into line with EU standards and introduces a modern system of integrated environmental permits based on BAT, as well as a comprehensive approach to the management of industrial emissions.
  • The development of secondary legislation enabling the full implementation of best available techniques in Ukraine is well advanced. The law implementing the IED provides for short deadlines for the adoption of secondary legislation. The Ministry of Economy, Environment, and Agriculture, with the support of GIZ, is therefore working intensively to present these regulations ready for approval. The Cabinet of Ministers of Ukraine has already adopted 12 pieces of secondary legislation.
  • International and domestic companies are developing software on behalf of the project that will enable permits for industrial facilities to be applied for and issued online. Development is now complete and comprehensive testing of the system has been carried out. The new register for integrated environmental permits was published on the state platform “Ecosystem” in August 2025 and is expected to be fully operational by the end of the year.
  • The project has developed a financing mechanism to support Ukrainian companies in implementing the best available techniques. The plan is to implement modernization measures to reduce emissions into the air and water and to treat on-site waste in food production and metal manufacturing companies, as well as to increase energy efficiency in paper and cardboard production. A total of four grant agreements have been signed to date to establish BAT in various Ukrainian companies' production facilities.
  • From the end of August 2025, with the support of the project, a series of training sessions on the new permit system were held, attended by relevant stakeholders, including representatives of companies, civil society organizations, and regional state administrations. A total of around 450 people took part in the training sessions.
  • With support for the project, the former Ukrainian Ministry of Environment (successor - MinEconomy) developed a concept for a state program to support companies that use and apply the Best Available Techniques for the period up to 2030.
  • The official kick-off event for the project took place on July 9, 2019 in Kyiv with the participation of a delegation from the German Federal Ministry for the Environment, Nature Conservation and Nuclear Safety (BMU). Among those present were Parliamentary State Secretary Rita Schwarzelühr-Sutter and Ukrainian Deputy Environment Minister Mykola Kuzio.
